supply and ensuring compliance with technical standards and regulations and includes inspectorate services carried out by the Commission;\">Inspectorate Service<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Institute\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Institute\u2019 means the National Power Training Institute of Nigeria established under section 185 (1) of this Act;\">Institute<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"ISO\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018ISO\u2019 Independent system operator means a system operator that is licensed by the Commission under Part IV of this Act;\">ISO<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Interim Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018interim market\u2019 means the stage of the Nigerian electricity market between the completion of privatisation and start of pre-transitional and transitional electricity market stages as regulated under the interim market rules and the Grid Code;\">Interim Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Land\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018land\u2019 means land, tenements, hereditaments aid appurtenances, or any estate or interest in it;\">Land<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Land Use Act\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Land Use Act\u2019 means the Land Use Act, Cap. LS, LFN 2004;\">Land Use Act<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Landfill Gas\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018landfill gas\u2019 means the gas produced inland fills due to the anaerobic digestion by microbes on any organic matter which can be collected and flared off or used to generate electricity in a thermal power plant;\">Landfill Gas<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018license\u2019 means a license issued by the Commission or State Electricity Board in accordance with the provisions of this Act;\">License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Licensed Facility\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018licensed facility\u2019 means a part of or the whole portion of a building, structure, equipment or plant that is licensed for the purpose of activities in the renewable energy industry;\">Licensed Facility<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Licensee\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018licensee\u2019 includes any person who holds a license or is deemed to hold a license issued under Part VI of this Act or under any other relevant provision of this Act;\">Licensee<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Lifeline Tariff\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018lifeline tariff' means a tariff set by the Commission with prices that incorporate cross subsidies by other customers and which may be enjoyed by such group of consumers as the Commission may designated under this Act;\">Lifeline Tariff<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Line\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018line\u2019 means any wire, cable, tube, pipe, insulator, conductor or other similar thing (including its casing or coating) which is designed or adapted for use in carrying electricity and includes any line which surrounds or supports, or is surrounded or supported by or is installed in close proximity to, or is supported, carried or suspended in association with, any such line;\">Line<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Local Authority\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018local authority\u2019 means a local government, municipal council, town council, rural district council or local beard;\">Local Authority<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Managing Director\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Managing Director\u2019 in relation to NEMSA means the Managing Director of NEMSA under Part XV: of this Act. \u2018Managing Director\u2019 in relation to the Agency means the Managing Director of the Rural Electrification Agency established under Part XVI of this Act;;\">Managing Director<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Medium Term Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018medium term market\u2019 refers to the market stage between the end of the Transitional electricity market and before declaration long term electricity market by the Commission under section 8 of this Act.\">Medium Term Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Market Power\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018market power\u2019 means the ability of a seller or group of sellers to maintain prices above competitive levels, or maintain stable prices while reducing the quality of product and services provided, for a significant period of time;\">Market Power<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Market Rules\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018market rules\u2019 means rules issued by the Commission under the provisions of this Act;\">Market Rules<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Mini Grid\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018mini grid renewable power system\u2019 means a network of electricity supply from renewable energy technologies which is not connected to the grid;\">Mini Grid<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Minister\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Minister\u2019 means the Minister responsible for power and include any other Minister to whom the President may assign administrative functions in respect of this Act;\">Minister<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"National Grid\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018national grid\u2019 means any electrical power system that transcends the boundaries of one or more states in Nigeria or that is connected to a country outside Nigeria for the purpose of electricity generation, transmission, system operation, distribution, supply and trading;\">National Grid<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"NBET Plc\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018NBET Plc\u2019 means the Nigerian. Electricity Bulk Trading Company Plc to which sections 6 (f) and 7 (21 (d) of this Act applies;\">NBET Plc<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"NEMSA\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018NEMSA\u2019 means the Nigerian Electricity Management Services Agency established under part XVIII of this Act;\n\">NEMSA<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"N-HYPPADEC\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018N-HYPPADEC\u2019 means the National Hydroelectric Power Producing Areas Development Commission established under section 82 of this Act;\">N-HYPPADEC<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Non-Depleting Resources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018non-depleting resources\u2019 means resources that replenish themselves or reproduce easily; '\">Non-Depleting Resources<\/b><\/a><\/li >\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Ocean Energy\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018ocean energy\u2019 means energy created by the power of ocean currents, waves and tides with the use of technology;\">Ocean Energy<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Off Grid Renewable Power System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018off grid renewable power system\u2019 means electricity supply from renewable energy technologies which is not connected to the grid;\">Off Grid Renewable Power System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Open Access\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018open access\u2019 means the non-disc ri minatory provision for use of transmission lines or distribution system; or associated facilities with such lines or system by any\n licensee or consumer or a person engaged in generation in accordance with the regulations specified the Commission or in a license;\">Open Access<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Other Agencies\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018other agencies\u2019 means NEMSA, N-HYPPADEC and NAPTIN established under this Act;\">Other Agencies<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Overhead Lines\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018overhead lines\u2019 means electric line which is placed above the ground and in the open air but does not include live rails of a traction system;\">Overhead Lines<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Person\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018person\u2019 includes an individual, company, partnership or any other association of individuals, whether incorporated or not;\">Person<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Power Consumer Assistance. agreement\u2019 means an agreement that sets out the rights and liabilities between the generator of electricity and the distribution utility;\">Power Purchase Agreement<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Power Station\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018power station\u2019 means an assembly of plant or equipment for the creation or generation of electricity of electrical energy.\">Power Station<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Power System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018power system\u2019 means all aspects of generation, transmission, distribution and supply of electricity and includes one or more of the following \u2014\n(a)\tgenerating stations;\n(b)\ttransmission or main transmission lines;\n(c)\tsub-stations;\n(d)\ttie -lines;\n(e)\tload dispatch activities;\n(f)\tmain or distribution mains;\n(g)\telectric supply lines;\n(h)\toverhead lines;\n(i)\tservice lines; end\n(j)\tworks.\n\">Power System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Pre-Transitional Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018pre-transitional market\u2019 refers to the stage of the Nigerian electricity market between the end of the interim market and before the declaration of a transitional\nelectricity market by the Minister as regulated under the pre-transitional market rules and the grid code;\">Pre-Transitional data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018public utility\u2019 means an institution which provides a basic service to the public, including water, electricity, transportation, or telecommunications;\">Public Utility<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"REF\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018REF\u2019 means the Rural Electrification Fund established under section 142 of this Act;\">REF<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Regulations\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018regulations\u2019 means regulations made by the Commission under the provisions of this data-bs-content=\"\u2018renewable energy companies\u2019 means a company licensed by the Commission to generate .electricity from renewable energy sources and include a company issued a permit for mini-grid or to deal in renewable energy products and services by whatever description;\">Renewable Energy Companies<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Product\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy product\u2019 means goods and service produced from renewable energy;\">Renewable Energy Product<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Resources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy resources\u2019 means natural resources such as sunlight, wind, rain, tides and geothermal heat, which are renewable and naturally replenished;\">Renewable Energy Resources<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Sources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy sources'\u2018 means renewable non-fossil energy sources like wind, solar, geothermal, wave, trial, hydropower, biomass, landfill gas;\n\">Renewable Energy Sources<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy system\u2019 means equipment that transforms renewable energy sources into electrical or heat energy;\">Renewable Energy System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"REREF\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018REREF\u2019 means the Rural Electrification and Renewable Energy Fund established under section 142 of this \/Vet;\">REREF<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" data-bs-content=\"\u2018Repealed Act\u2019 means the Electric Power Sector Reform Act, No. 6, 2005 and includes Acts repealed under section 232 of this Act;\">Repealed Act<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Rules\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018rules\u2019 means market rules approved by the Commission and include class=\"dropdown-item\" href=\"#\" title=\"Solid Waste\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018solid waste\u2019 includes waste that arises from domestic activity and is predominantly household and commercial waste collected by a municipality within a given area in a solid or semi-solid form but excludes industrial hazardous waste and toxic waste;\n\">Solid Waste<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Schedules\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Schedules\u2019 means the Schedules to this Act;\">Schedules<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"TCN\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018TCN\u2019 in the line of such street, highway or road;\n(c)\tany approach, culvert, cutting, dam, ditch, drain, embankment, fence, grid, guard, kerb, parapet, subway or other work or thing belonging to or connected with or forming part of such street, highway or road; and\n(d)\tany sanitary lane or private street;\n\">Street<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" Companies<\/b><\/a><\/li> \n<li><a class=\"dropdown-item\" href=\"#\" title=\"Supply\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018supply\u2019, in relation to electricity, means the sale of electricity to a licensee or consumer;\">Supply<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Supply License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018supply license\u2019 means license granted under section 69 of this Act;\">Supply License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"System Operation\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018system operation\u2019 means the operation of one or more transmission systems and \u2018system operator\u2019 shall be construed accordingly;\">System Operation<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"System Operation License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018system operation license\u2019 means a license granted under section 67 of this Act;\">System Operation License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Tariff\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018tariff means a tariff approved by the Commission under the provisions of this Act that specifies the prices, terms and conditions under which electricity service is to be provided;\">Tariff<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Technical Support Services\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018technical support services in relation to NEMSA established under Part XIX of this Act\u2019 means specialised technical services provided in the NESI by the NEMSA; \u2018technical support services means specialised technical services provided in the Nigerian electricity supply industry by the Agency specified in Part XVI of this Act.\">Technical Support Services<\/b><\/a><\/li> \n<li><a class=\"dropdown-item\" href=\"#\" title=\"Trading\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018trading\u2019 means any form of marketing, brokering or intermediation in the sale of electricity, whether or not it entails the purchase of electricity for resale, or whether or not title is taken to the electricity sold;\n\">Trading<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Trading License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018trading license\u2019 means a license issued under section 69 of this Act;\">Trading License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission\u2019 means the conveyance of electric power and energy over a transmission system;\">Transmission<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission Licensee\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission licensee\u2019 means a person licensed to transmit electricity under the provisions of this Act;\">Transmission Licensee<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmit\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmit\u2019 means conveyance of electricity by means of transmission lines and the expression \u2018transmission\u2019 shall be construed accordingly;\">Transmit<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission system\u2019 means a system, as defined by the Commission, consisting wholly or mainly of high voltage (greater than or equal to 132kV) electric lines for the conveyance of electricity within an undertaking or from one undertaking to another, including any transmission lines, transformers, switchgear and other works necessary for and used in connection with such electrical equipment, and the buildings as may be required to accommodate the transformers, switchgear and other works;\">Transmission System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission Lines\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission lines\u2019 means all high pressure cables and overhead lines (not being an essential part of the \u2018distribution system of a licensee) transmitting electricity from a generating station to another generating station or a substation, together with any step-up and step-down transformers, switch-gear and other works necessary to and used for the control of such cables or overhead lines, and such buildings or part of it as may be required to accommodate such transformers, switch-gear and other works;\">Transmission Lines<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transitional Electricity Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transitional electricity market\u2019 means to the stage of the Nigerian electricity market commenced between the end of the pre-transitional electricity and before the declaration of the medium term electricity market, and for the purpose of this Act;\">Transitional Electricity Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"TSP\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018TSP\u2019 means transmission service provider recognised under section 15 (2) (b) of this Act.\n\u2018undertaking\u2019 means the electric lines or electrical plant, and includes all lands, buildings, works and materials attached to it belonging to any person acting as a generating company or licensee under the provisions of this Act;\n\">TSP<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Wheeling\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018wheeling\u2019 means the operation whereby the distribution system and associated facilities of a transmission licensee or distribution licensee, as the case may be, are used by another person for the conveyance of electricity on payment of charges to be determined under the provisions of this Act; and\">Wheeling<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Works\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018works\u2019 includes electric data-bs-trigger=\"hover\" data-bs-content=\"'captive generation' means generation of electricity for the purpose of consumption by the generator and which is consumed by the generator itself and not sold to a third party;\">Captive Generation<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Code of Conduct\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"'Code of Conduct' means any .rules established by the Commission governing behavior, relationships, and practices between licensees and their affiliates;\n\">Code of Conduct<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Cogeneration\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201ccogeneration\u201d means a process which simultaneously produces two. or more forms of useful energy (including electricity);\">Cogeneration<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Commission\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cCommission\u201d means the Nigerian Electricity Regulatory Commission established under Part V of this Act;\">Commission<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Companies and Allied\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"'Companies and Allied Matters' Act means the Companies and Allied Matters Act, No, 3, 2020;\">Companies and Allied Matters Act<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Competition\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"competition transition charge means any charge prescribed under section 13 of this Act;\">Competition<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Constitution\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cConstitution\u201d means Constitution of the Federal Republic of Nigeria 1999, Cap, C23, Laws of the Federation of Nigeria, 2004\";>Constitution<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Consumer\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"'consumer' means any end-user of electricity who is a customer of a distribution licensee, franchisee, mini- grid operator or other permit holders that is not an eligible customer and, for purposes of filing a complaint with the Commission and for any other reason that the Commission may determine, a person who is temporarily disconnected or otherwise without service, provided that a person who has applied, for, but has yet to receive, service shall also be deemed to be a consumer;\">Consumer<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Control Area\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"control area means a transmission system or interconnected transmission systems, and reasonable limits in accordance with good utility practice;\n(d)\tmaintain power flows on transmission facilities within appropriate limits to preserve reliability; and\n(e)\tprovide sufficient class=\"dropdown-item\" href=\"#\" title=\"Distribution\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"Distribution means the delivery of electricity over a distribution system; \">Distribution<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Distribution License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"Distribution license means a license granted under section 63;\">Distribution License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Distribution Licensee\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"Distribution licensee means a licensee authorised under this Act to operate and maintain a distribution system for supplying electricity to the consumers in his area of supply of operation;\">Distribution Licensee<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Distributing Main\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"Distributing main - means the portion of any main with which a service line is, or is intended to be, immediately connected;\">Distributing Main<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Distribution System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"'distribution system' means the system of facilities, as defined by the Commission, consisting wholly or mainly of low voltage (less than 132k V) electric lines used for the distribution of electricity from grid supply points to the point of delivery to consumers or eligible customers, and includes any electrical plant and meters operated in connection with the distribution of electricity, but shall not include any part of a transmission system;\">Distribution System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Electric Line\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"electric line means any line which is used for carrying electricity for any purpose and includes \u2014\n(a)\tany support for any such line, that is to say, any structure, tower, pole or other thing in, on, by or from which any such line is, or may be, supported, carried or suspended; and\n(b)\tany apparatus connected to any such line for the purpose of carrying electricity;\">Electric Line<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Electrical Plant\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"electrical plant means any plant, equipment, apparatus or appliance or any part thereof used for, or connected with, the generation, transmission, distribution or supply of electricity but does not include \u2014\n(a)\tan electric line; or\n(b)\ta meter used for ascertaining the quantity of electricity supplied to any premises; or\n(c)\tan. electrical equipment, apparatus or appliance under the control of a consumer;\">Electrical Plant<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Electricity\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"electricity means electrical energy \u2014\n(a)\tgenerated, transmitted, distributed and supplied or traded for any purpose; or (b)\tused for any purpose except the transmission of a message;\">Electricity<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Electricity Supply Code\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"electricity supply code means the electricity supply code under the provisions of this Act\";>Electricity Supply Code<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Electricity System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"electricity system means a system under the control of a generating company or licensee, as the case may be, having one or more \u2014\n(a)\tgenerating stations,\n(b)\ttransmission lines, or\n(c)\telectric lines and sub-stations,\nand when used in the context of a State the entire electricity system within the territories;\">Electricity System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Electricity Trader\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"electricity trader means a person who has been granted a license to undertake trading in electricity under section 69 of this Act;\">Electricity Trader<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Eligible Customer\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"eligible customer means and include a customer that is eligible, under the directives issued by the Minister under the Repealed Act and under the declaration\n made by the Commission under the provisions of section 12 of this Act, to purchase power from a licensee other than a distribution licensee;\n\">Eligible Customer<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Energy Crop\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cenergy crop\u201d includes a plant \u2014\n(a)\tthat can be directly exploited for its energy content,\n(b)\tthat is grown for the sole purpose of energy production but not for food production, or\n(c)\tthat is grown specifically for its fuel value;\">Energy Crop<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Energy Security\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cenergy security\u201d means the availability, adequacy, reliability and environmental sustainability of energy supply;\n\">Energy Security<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Energy Sources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cenergy sources\u201d includes coal, wind, oil, gas or wood consumed in the generation of power;\">Energy Sources<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"FEC\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"FEC means the Federal Executive Council referred to under sections 3 (3) and 4 of this Act;\">FEC<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Feedstock\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cfeedstock\u201d means a material that can be used to produce bio-fuel;\">Feedstock<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Franchisee\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cfranchisee\u201d means a persons authorised by a distribution licensee to distribute electricity on its behalf in a particular area within his area of supply;\">Franchisee<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Functions\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u201cfunctions\u201d includes duties, roles, responsibilities and powers;\">Functions<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Generating Station\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"generating station or \u201cstation\u201d means any station for generating electricity, including any building and plant with step-up transformer, switchgear, switch yard, cables or other appurtenant equipment, if any, used for that purpose and the site, a site intended to be used for a generating station, and any building used for housing the operating staff of a generating station, and where electricity is generated by water-power, includes penstocks, head and tail works, main and regulating reservoirs, dams and other hydraulic works, but does not in any case include any sub-station;\">Generating Station<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Generation\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"'generation' means the production at a generating station of electric power and other generation products such as reactive power;\">Generation<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Generation License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"'generation license' means a license issued under section 65 of this Act;\">Generation License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Generating Station\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018generating station\u2019 means a station for generating electricity, including buildings, plant and machinery and all accessories used for that purpose and the site to be used for the station or accessories;\">Generating Station<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Generator of Electricity\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018generator of electricity\u2019 m cans the person that generates electricity from renewable energy sources and supplies it to the general public;\">Generator of Electricity<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Geothermal Energy\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018geothermal energy\u2019 means energy extracted from heat stored in the earth;\">Geothermal Energy<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Grid Connection\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018grid connection\u2019 means the linkage between a renewable energy system and the utility grid;\">Grid Connection<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Grid Interactive Renewable Electricity\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018grid interactive renewable electricity\u2019 means a. system which has the capacity to feed electricity from renewable energy source into the utility grid;\">Grid Interactive Renewable Electricity<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Grid\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018grid\u2019 means the high voltage backbone system of inter-connected transmission lines, sub-stations and generating plants;\">Grid<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Grid Code\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Grid Code\u2019 means instructions, rules, procedures, guidelines for the operation and planning of an interconnected power system and accounting requirements relating to it;\">Grid Code<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Grid Standards\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Grid Standards\u2019 means the grid standards issued by the Commission under the provisions of this Act;\">Grid Standards<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Hydro\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018hydro\u2019 means a project that has a generating capacity not exceeding 100 megawatts;\">Hydro<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Independent Power Producer\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018independent power producer\u2019 means an entity that is granted a generation license by the Commission or State Electricity Boards under the reform of the Nigerian Electric Power Sector under Repealed Act and include those licensed under this Act;\n\">Independent Power Producer<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"IEDNS and IEDNOS\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018IEDNs and IEDNOs\u2019 means independent electricity distribution network and independent electricity distribution network operators respectively, recognised under section 63(2)(b) and (7) of this Act;\">IEDNS and IEDNOS<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"IBTN and IETNOS\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018IBTN and IETNOs\u2019 means independent electricity transmission network and independent electricity transmission network operators respectively, recognised under section 63(2 )(b) and (7) of this Act;\">IBTN and IETNOS<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Inspecting Engineer\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018inspecting engineer\u2019 means a qualified person holding office under NEMSA as specified under Part XVII of this Act, including his deputy and his assistants.\">Inspecting Engineer<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Inspectorate Service\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018inspectorate service\u2019 means technical services provided by NEMSA in the electricity supply industry to ensure safety of use and reliability of supply and ensuring compliance with technical standards and regulations and includes inspectorate services carried out by the Commission;\">Inspectorate Service<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Institute\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Institute\u2019 means the National Power Training Institute of Nigeria established under section 185 (1) of this Act;\">Institute<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"ISO\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018ISO\u2019 Independent system operator means a system operator that is licensed by the Commission under Part IV of this Act;\">ISO<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Interim Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018interim market\u2019 means the stage of the Nigerian electricity market between the completion of privatisation and start of pre-transitional and transitional electricity market stages as regulated under the interim market rules and the Grid Code;\">Interim Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Land\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018land\u2019 means land, tenements, hereditaments aid appurtenances, or any estate or interest in it;\">Land<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Land Use Act\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Land Use Act\u2019 means the Land Use Act, Cap. LS, LFN 2004;\">Land Use Act<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Landfill Gas\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018landfill gas\u2019 means the gas produced inland fills due to the anaerobic digestion by microbes on any organic matter which can be collected and flared off or used to generate electricity in a thermal power plant;\">Landfill Gas<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018license\u2019 means a license issued by the Commission or State Electricity Board in accordance with the provisions of this Act;\">License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Licensed Facility\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018licensed facility\u2019 means a part of or the whole portion of a building, structure, equipment or plant that is licensed for the purpose of activities in the renewable energy industry;\">Licensed Facility<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Licensee\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018licensee\u2019 includes any person who holds a license or is deemed to hold a license issued under Part VI of this Act or under any other relevant provision of this Act;\">Licensee<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Lifeline Tariff\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018lifeline tariff' means a tariff set by the Commission with prices that incorporate cross subsidies by other customers and which may be enjoyed by such group of consumers as the electricity and includes any line which surrounds or supports, or is surrounded or supported by or is installed in close proximity to, or is supported, carried or suspended in association with, any such line;\">Line<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Local Authority\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018local authority\u2019 means a local government, municipal council, town council, rural district council or local beard;\">Local Authority<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Managing Director\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Managing Director\u2019 in relation to NEMSA means the Managing Director of NEMSA under Part XV: of this Act. \u2018Managing Director\u2019 in relation to the Agency means the Managing Director of the Rural Electrification Agency established under Part XVI of this Act;;\">Managing Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Market Power\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018market power\u2019 means the ability of a seller or group of sellers to maintain prices above competitive levels, or maintain stable prices while reducing the quality of product and services provided, for a significant period of time;\">Market Power<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Market Rules\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018market rules\u2019 means rules issued by the Commission under the provisions of this Act;\">Market Rules<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Mini Grid\" data-bs-toggle=\"popover\" Minister responsible for power and include any other Minister to whom the President may assign administrative functions in respect of this Act;\">Minister<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"National Grid\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018national grid\u2019 means any electrical power system that transcends the boundaries of one or more states in Nigeria or that is connected to a country outside Nigeria for the purpose of electricity generation, transmission, system operation, distribution, supply and trading;\">National Grid<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"NBET Plc\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018NBET Plc\u2019 means the Nigerian. Electricity Bulk Trading Company Plc to which sections 6 (f) and 7 (21 (d) of this Act applies;\">NBET Plc<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"NEMSA\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018NEMSA\u2019 means the Nigerian Electricity Management Services Agency established under part XVIII of this Act;\n\">NEMSA<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"N-HYPPADEC\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018N-HYPPADEC\u2019 means the National Hydroelectric Power Producing Areas Development Commission established under section 82 of this Act;\">N-HYPPADEC<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Non-Depleting Resources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018non-depleting resources\u2019 means resources that replenish themselves or reproduce easily; '\">Non-Depleting Resources<\/b><\/a><\/li >\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Ocean Energy\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018ocean energy\u2019 means energy created by the power of ocean currents, waves and tides with the use of technology;\">Ocean Energy<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Off Grid Renewable Power System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018off grid renewable power system\u2019 means electricity supply from renewable energy technologies which is not connected to the grid;\">Off Grid Renewable Power System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Open Access\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018open access\u2019 means the non-disc ri minatory provision for use of transmission lines or distribution system; or associated facilities with such lines or system by any\n licensee or consumer or a person engaged in generation in accordance with the regulations specified the Commission or in a license;\">Open Access<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Other Agencies\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018other agencies\u2019 means NEMSA, N-HYPPADEC and NAPTIN established under this Act;\">Other Agencies<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Overhead Lines\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018overhead lines\u2019 means electric line which is placed above the ground and in the open air but does not include live rails of a traction system;\">Overhead Lines<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Person\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018person\u2019 includes an individual, company, partnership or any other association of individuals, whether incorporated or not;\">Person<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Power Consumer Assistance. Fund\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Power Consumer Assistance. Fund\u2019 means the Power Fund established under section 97 of this Act;\">Power Consumer Assistance. agreement\u2019 means an agreement that sets out the rights and liabilities between the generator of electricity and the distribution utility;\">Power Purchase Agreement<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Power Station\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018power station\u2019 means an assembly of plant or equipment for the creation or generation of electricity of electrical energy.\">Power Station<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Power System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018power system\u2019 means all aspects of generation, transmission, distribution and supply of electricity and includes one or more of the following \u2014\n(a)\tgenerating stations;\n(b)\ttransmission or main transmission lines;\n(c)\tsub-stations;\n(d)\ttie -lines;\n(e)\tload dispatch activities;\n(f)\tmain or distribution mains;\n(g)\telectric supply lines;\n(h)\toverhead lines;\n(i)\tservice lines; end\n(j)\tworks.\n\">Power System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Pre-Transitional Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018pre-transitional market\u2019 refers to the stage of the Nigerian electricity market between the end of the interim market and before the declaration of a transitional\nelectricity market by the Minister as regulated under the pre-transitional market rules and the grid code;\">Pre-Transitional Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Production-Based Subsidy\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018production-based subsidy means financial assistance given for the generation of electricity;\">Production-Based Subsidy<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Public Utility\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018public utility\u2019 means an institution which provides a basic service to the public, including water, electricity, transportation, or telecommunications;\">Public Utility<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"REF\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018REF\u2019 means the Rural Electrification Fund established under section 142 of this Act;\">REF<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Regulations\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018regulations\u2019 means regulations made by the Commission under the provisions of this Act;\">Regulations<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Relative\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018relative\u2019 means energy;\">Renewable Energy Certificates<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Companies\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy companies\u2019 means a company licensed by the Commission to generate .electricity from renewable energy sources and include a company issued a permit for mini-grid or to deal in renewable energy products and services by whatever description;\">Renewable Energy Companies<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Product\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy product\u2019 means goods and service produced from renewable energy;\">Renewable Energy Product<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Resources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy resources\u2019 means natural resources such as sunlight, wind, rain, tides and geothermal heat, which are renewable and naturally replenished;\">Renewable Energy Resources<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy Sources\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy sources'\u2018 means renewable non-fossil energy sources like wind, solar, geothermal, wave, trial, hydropower, biomass, landfill gas;\n\">Renewable Energy Sources<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Renewable Energy System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018renewable energy system\u2019 means equipment that transforms renewable energy sources into electrical or heat energy;\">Renewable Energy System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"REREF\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018REREF\u2019 means the Rural Electrification and Renewable Energy Fund established under section 142 of this \/Vet;\">REREF<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"RESIP\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018RESIP\u2019 means the Rural Electrification Strategy and Implementation Plan to be prepared under section 151 of this Act;\">RESIP<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Repealed Act\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Repealed Act\u2019 means the Electric Power Sector Reform Act, No. 6, 2005 and includes Acts repealed under section 232 of this Act;\">Repealed Act<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Rules\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018rules\u2019 means market rules approved by the Commission and include other rules made under the provisions of this Act;\">Rules<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Sewage Gas\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018sewage gas\u2019 means biogas produced by tire digestion and incineration of sewage sludge which can be used to generate energy;\">Sewage Gas<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Solid Waste\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018solid waste\u2019 includes waste that arises from domestic activity and is predominantly household and commercial waste collected by a municipality within a given area in a solid or semi-solid form but excludes industrial hazardous waste and toxic waste;\n\">Solid Waste<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Schedules\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018Schedules\u2019 means the Schedules to this Act;\">Schedules<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"TCN\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018TCN\u2019 means the Transmission Company of Nigeria Plc, the transmission licensee to which Part IV of this Act applies;\">TCN<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Security\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018security\u2019 means shares, debentures, bonds and other securities of a company recognised under the Companies and Allied distributing main or immediately from the distribution licensee's premises; or\n\n(b)\tfrom a distributing main, to a group of consumers on the same premises or on contiguous premises supplied from the same point of the distributing main;\n\">Service-Line<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Six Geo-Political Zones\" data-bs-toggle=\"popover\" means any street, highway, or road, or any part of a street, highway or road, and includes \u2014\n(a)\t\tany bridge, ferry or pontoon over which such street, highway or road passes;\n(b)\tany drift in the line of such street, highway or road;\n(c)\tany approach, culvert, cutting, dam, ditch, drain, embankment, fence, grid, guard, kerb, parapet, subway or other work or thing belonging to or connected with or forming part of such street, highway or road; and\n(d)\tany sanitary lane or private street;\n\">Street<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Sub-Station\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018sub-station\u2019 means a station for transforming or converting electricity for the transmission or distribution and includes transformers converters, switchgears, capacitors, synchronous condensers, structures, cable and other appurtenant equipment and any buildings used for that purpose and the companies \u2018means the 18 companies listed in Part I of the First Schedule to this Act which were created following the restructuring of the Authority under the Repealed Act;\">Successor Companies<\/b><\/a><\/li> \n<li><a class=\"dropdown-item\" href=\"#\" title=\"Supply\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018supply\u2019, in relation to electricity, means the sale of electricity to a licensee or consumer;\">Supply<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Supply License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018supply license\u2019 means license granted under section 69 of this Act;\">Supply License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"System Operation\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018system operation\u2019 means the operation of one or more transmission systems and \u2018system operator\u2019 shall be construed accordingly;\">System Operation<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"System Operation License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018system operation license\u2019 means a license granted under section 67 of this Act;\">System Operation License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Tariff\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018tariff means a tariff approved by the Commission under the provisions of this Act that specifies the prices, terms and conditions under which electricity service is to be provided;\">Tariff<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Technical Support Services\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018technical support services in relation to NEMSA established under Part XIX of this Act\u2019 means specialised technical services provided in the NESI by the NEMSA; \u2018technical support services means specialised technical services provided in the Nigerian electricity supply industry by the Agency specified in Part XVI of this Act.\">Technical Support Services<\/b><\/a><\/li> \n<li><a class=\"dropdown-item\" href=\"#\" title=\"Trading\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\n\u2018trading\u2019 means any form of marketing, brokering or intermediation in the sale of electricity, whether or not it entails the purchase of electricity for resale, or whether or not title is taken to the electricity sold;\n\">Trading<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Trading License\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018trading license\u2019 means a license issued under section 69 of this Act;\">Trading License<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission\u2019 means the conveyance of electric power and energy over a transmission system;\">Transmission<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission Licensee\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission licensee\u2019 means a person licensed to transmit electricity under the provisions of this Act;\">Transmission Licensee<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmit\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmit\u2019 means conveyance of electricity by means of transmission lines and the expression \u2018transmission\u2019 shall be construed accordingly;\">Transmit<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission System\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission system\u2019 means a system, as defined by the Commission, consisting wholly or mainly of high voltage (greater than or equal to 132kV) electric lines for the conveyance of electricity within an undertaking or from one undertaking to another, including any transmission lines, transformers, switchgear and other works necessary for and used in connection with such electrical equipment, and the buildings as may be required to accommodate the transformers, switchgear and other works;\">Transmission System<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transmission Lines\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transmission lines\u2019 means all high pressure cables and overhead lines (not being an essential part of the \u2018distribution system of a licensee) transmitting electricity from a generating station to another generating station or a substation, together with any step-up and step-down transformers, switch-gear and other works necessary to and used for the control of such cables or overhead lines, and such buildings or part of it as may be required to accommodate such transformers, switch-gear and other works;\">Transmission Lines<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Transitional Electricity Market\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018transitional electricity market\u2019 means to the stage of the Nigerian electricity market commenced between the end of the pre-transitional electricity and before the declaration of the medium term electricity market, and for the purpose of this Act;\">Transitional Electricity Market<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"TSP\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018TSP\u2019 means transmission service provider recognised under section 15 (2) (b) of this Act.\n\u2018undertaking\u2019 means the electric lines or electrical plant, and includes all lands, buildings, works and materials attached to it belonging to any person acting as a generating company or licensee under the provisions of this Act;\n\">TSP<\/b><\/a><\/li>\n<li><a class=\"dropdown-item\" href=\"#\" title=\"Wheeling\" data-bs-toggle=\"popover\" data-bs-trigger=\"hover\" data-bs-content=\"\u2018wheeling\u2019 means the operation whereby the distribution system and associated facilities of a transmission licensee or distribution licensee, as the case may be, are used by another person for the conveyance of electricity on payment of charges to be determined under the provisions of this Act;
