PART XII - ACQUISITION OF LAND AND ACCESS TO LAND


Part XII of the Electricity Act 2023 comprises only section 118. Its purpose is to ensures that land acquisition for electricity projects is done fairly and transparently, balancing the needs of electricity projects with the rights of landowners.

The following are the highlights of this section:



Land Acquisition for Electricity Projects
  • Voluntary and Compulsory Procedures: Land and access rights for electricity projects are acquired through both voluntary and compulsory procedures in compliance with this Act, the Land Use Act, and relevant regulations.
Access Rights for Licensees
  • Entitlement: Generation, transmission, and distribution licensees have access rights over lands, buildings, and streets to fulfill their obligations under their licenses. These rights are defined by the Commission’s regulations.
Disposal of Unrequired Land
  • Offer to Previous Holder: If a licensee no longer needs the land acquired through compulsory acquisition, they must offer it back to the previous holder at a price reflecting the value of improvements made by the licensee.

  • Alternate Offer: If the previous holder is not interested, the land can be offered to others under terms directed by the Commission.
